These Terms of Service (“Terms”) govern your access to and use of the website kialagreens.com and all products offered by FOODSTATE, INC. (EIN 02-0436846), operating under the brand name FOODSTATE INC (“we,” “us,” or “our”). By accessing our website you agree to be bound by these Terms.

1. Agreeing to this

Browsing the site, buying from it, or asking for our text or email messages all count as accepting these terms and the Privacy Policy. If any part of them does not suit you, the remedy is simply not to use the site, and nothing is owed either way.

2. Minimum age

Nothing here is sold to anybody under 18, and nobody under 18 can be added to the text programme. Placing an order is a statement that you are over that age and can enter into a binding agreement.

Where you give a mobile number and tick the consent box, you are agreeing under the Telephone Consumer Protection Act (TCPA) that FOODSTATE INC may send you recurring automated marketing and informational text messages at that number. What that commits each side to is set out below.

5. Refund and Guarantee Policy

We offer a 60-day money-back guarantee on all purchases. To initiate a return, contact us at hello@kialagreens.com. Refunds are processed to the original payment method within 5-10 business days after we receive the returned product.

6. Ownership of the content

The text, images, layout and code on this site belong to FOODSTATE, INC. or to the parties who licensed them to us, and are protected by intellectual property law. Copying, republishing or building something derived from them needs our written permission first.

7. Liability cap

Our liability to you is limited to the sum you paid for the product the claim concerns. To the fullest extent the law permits, FOODSTATE, INC. accepts no liability for indirect, incidental, special, consequential or punitive damages of any kind connected with this website or the products on it.

8. Law and venue

This agreement is made under the laws of the State of New Hampshire, United States, with conflict-of-law principles disregarded, and any proceeding belongs in the courts sitting in New Hampshire. Consumer protections available to you under your own state's law are unaffected.

9. Changes to these terms

These terms can change. When they do, the new version appears on this page with the date it was revised, and carrying on using the site afterwards is how you accept it. The terms that govern an order are the ones published when you placed it.

11. Crop years, lots and withdrawals

  • Goods are agricultural. Crop years differ, and where a crop year tests differently from the last, the label says so rather than the difference being smoothed over.
  • Every unit carries a lot number tied to a log entry, a field and a set of release tests. FOODSTATE, INC. will supply all of it on request at no charge.
  • A batch that misses a release limit is quarantined and destroyed rather than reworked or blended into a passing batch.
  • When a line is out of stock it stays out until the next crop. We do not substitute and we do not take payment against a harvest that has not happened.
  • If a lot is withdrawn, we contact the people who received it from the lot record, refund in full, and do not require the goods back first.
  • Whatever rights your own state gives you survive everything written here. Where the two differ, whichever is better for you applies.
